In a closely watched development, President Biden will nominate D.C. Circuit Judge Ketanji Brown Jackson to the Supreme Court to fill a vacancy opened when Justice Stephen Breyer announced his retirement. Judge Jackson is a graduate of Harvard Law School and during her time on the bench has issued several rulings that bear upon issues frequently reoccurring in data privacy and cybersecurity litigation. This includes dismissing a data privacy class action upon finding that plaintiff, who alleged that an online company violated its privacy policy and terms of use by allowing third-party entities to collect the personal information of plaintiff and class members, lacked Article III standing to bring her claims.
